By means of present petition filed under Article 226 of the Constitution, petitioner has questioned dated 15th January, 2025. Upon pointed querry being made, learned Standing Counsel submits that charge-sheet has already been approved by the competent authority and will be served upon the petitioner within a maximum period of two weeks from today. In the given facts and circumstances of the case, we find that petitioner has been placed under suspension after preliminary fact finding enquiry was held in the matter and report was submitted on 20.09.2024 regarding alleged charges, it would not be appropriate to interfere with the suspension order at this stage. However, petitioner would be certainly entitled to benefit of undue delay in disciplinary proceeding as he cannot be continued under suspension indefinitely.
