By means of this petition filed under Article 226 of the Constitution, petitioner is questioning the order of suspension dated 27.11.2024 for the reason that main guilty person to whom the show cause ntoice was issued, was one Upendra Narayan Tripathi, Assistant Teacher for alleged misconduct and indiscipline to which he had submitted reply on 30.01.2021 and therefore, there was no involvement of the petitioner in the alleged act of any misconduct and indiscipline. 3. It is further submitted that the petitioner has been wrongly saddled with the liability of misconduct for not putting up records/ file which according to the work assignment he was dealing with even though the concerned file was received by one Amit Kumar Dwivedi who has also been exonerated by issuing a warning only.
