Although this petition is directed for a relief in the nature of writ of mandamus commanding the respondents to open the sealed cover envelope to promote the petitioner on the post of Head Constable from the post of Constable which he currently holds but it appears from the counter affidavit that the petitioner was awarded censure entry in the year 2019 and hence for a period of three years he could not be promoted. 3. In such circumstances, therefore, I find it appropriate for the respondents to first proceed to open the sealed cover envelope if at all the rule has been applied while preparing the promotion list in the year 2022 and in the event, the petitioner does not succeed or his candidature has been rejected on the ground of entry of censure then his claim will be considered afresh for
