Ordinarily, in these circumstances, Court would have relegated the matter back to the IO for holding re-inquiry from the stage of furnishing the defence documents to the Petitioner but this course of action does not appeal at this stage for the reason that even on earlier occasion when the Division Bench had remitted the matter, the directions were flouted and secondly, the charge sheet was issued in the year 1991 and Petitioner has already suffered two inquiry proceedings in the last nearly 4 decades.
