The allegation against the accused/applicant is that he stole mobile phone of the complainant de facto. According to prosecution, from an App installed in the mobile phone, presence of the phone was found in the carry away food joint being run by mother of the accused/applicant. Further, it appears from paragraph 12 of the FIR that the only information registered was theft of the mobile phone and that the detailed statement was to be recorded by the Investigating Officer at a later stage. 2.
