This writ petition has been filed in public interest, restraining the respondents from constructing a godown/fair price shop over land comprised in Gata No. 196 of Village Hayatpur Mafi, Tehsil and District Etah. The ground urged by the petitioner, who is a permanent resident of the Village Hayatpur is that he has no personal interest in the controversy, but the construction of a godown and fair price shop is against the public interest at large, inasmuch as Gata No. 196 is an abadi site and the road connecting Gata no. 196 to the main road is very narrow which is difficult for even a light motor vehicles to access. It is argued that the fair price shop is being constructed on that site and the card holders will suffer immeasurable inconvenience.
