Sri Indrajeet Shukla, learned Additional Chief Standing Counsel on the basis of instructions has stated that the resolution was passed by the gram sabha for construction of the fair price shop on the gaon sabha land and the resolution so passed has duly been approved by the Sub- divisional Magistrate. 2. It is further evident from the instructions placed before us that the site in question has been chosen looking to the convenience of supply, storage and distribution. The government order for establishment of such fair price shops in the village area lays emphasis on locational value i.e. conducive to the supply, storage and distribution. All the three aspects have been taken into account while passing the resolution. 3. The present PIL does not state any facts germane to the cause.
