Having heard the learned counsels for the parties and on perusal of the record, this Court proceeds to decide the present appeal under Section 37(1)(c) of the Arbitration and Conciliation Act, 1996 (‘A&C Act’) thereby assailing the order dated 09.02.2023 passed by the learned ADJ-03, West District, thereby upholding the award dated 08.10.2009 passed by the learned Sole Arbitrator. 2. Briefly stated, the dispute between the parties arose out of the works contract dated 26.05.2001 awarded to the respondent no.1/decree holder which pertained to the work of special repair and maintenance of 1040 slum tenements at Raghubir Nagar, behind Shivaji College, having Sub- Signature Not Verified FAO 128/2023 Digitally Signed By:PRAMOD Page 1 of 6 KUMAR VATS Signing Date:01.05.2025 13:10:03 Head: Special Repair to recently allotted (48 nos.) Flats 73 A B C to 88 A B C in Block A. The tender amount was for a sum of ₹6,55,079/- and the stipulated date of start of the work was 05.06.2001 to be completed in three months, pertaining to which the Agreement dated 06.06.2001 was executed between the parties inter alia containing Clause 25 for reference of disputes to arbitration. 3.
