Neutral Citation No. - 2025:AHC:61524-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 7742 of 2025 Petitioner :- Birendra Tiwari @ Birendra Prasad Tripathi And 2 Others Respondent :- State Of U.P. & 3 Others Counsel for Petitioner :- Pawan Shukla Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Anil Kumar-X,J. 1. At the very outset, Sri G.P.Singh, learned AGA-I on the instructions states that during investigation no complicity of the second petitioner was found in the instant case and accordingly he has been exonerated. So far as first and third petitioners are concerned, investigation has already been concluded and charge- sheet has been forwarded against them to the competent court. 2. Confronted with this situation, learned counsel for the petitioners fairly states that the writ petition may be dismissed as not pressed leaving it open to challenge the charge-sheet in appropriate proceedings as per law qua the first and third petitioners. 3. Consequently, the writ petition stands dismissed as not pressed with the aforesaid leave. (Anil Kumar-X,J.) (Mahesh Chandra Tripathi,J.)
