This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Vicky @ Akash, seeking enlargement on bail in Case Crime No. 302 of 2024, under Sections 5g/6 of POCSO Act, Police Station- Kandhla, District- Shamli. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 17.09.2024. Learned counsel for the applicant submits that as per the statement of the victim recorded under Section 183 B.N.S.S., no allegation of rape/sexual assault or harm has been levelled against the applicant and the medical examination report does not corroborate with the allegation made in the FIR
