The instant bail application has been filed seeking release of the applicant on bail in Case Crime No. 0653 of 2021, under Section 302 IPC, Police Station Dibiyapur, District Auraiya during pendency of the trial. 3. Learned counsel for the applicant submits, applicant is husband and however as per allegation he committed the murder of his wife and post mortem also suggests that deceased died due to strangulation but during trial all the witnesses of fact have been declared hostile. 4. He further submits, in the present matter applicant is in jail since 26.11.2021 i.e. for last more than three years, therefore, considering all these facts, he should be released on bail. 5.
