This bail application under Section 439 Cr.P.C. has been moved on behalf of accused-applicant, Amit @ Chela Diwakar , seeking enlargement on bail in Special Case No. 158 of 2014, arising out of Case Crime No. 39 of 2014, under Sections 395, 412 IPC and 10/15 D.A.A. Act, Police Station Pachhon Gaon, District Etawah. 3. The allegation made in the FIR is that on 13.08.2014, when the informant was going along with his wife on a motorcycle, in the midway, three unknown miscreants came on a black colour Pulsar motorcycle and forcefully stopped them, thereafter they have started assaulting to them on the pistol point and looted golden ornaments, mobile and cash etc. 4.
