Heard Sri Ashish Pandey, learned counsel for the applicant and Sri Ram Sakal Yadav, learned counsel for the informant as well as Sri Pranshu Kumar, learned State Law Officer and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.362 of 2024, under Sections 64(1), 351(2) B.N.S., Police Station- Shyamdeurwa, District- Maharajganj, during the pendency of trial. 4. As per prosecution story, the applicant is stated to be brother- in-law (Jeth) of the victim and had committed rape with her in the night of 1.12.2024 at about 10:00 p.m. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by about five days and there is no explanation of the said delay caused. It is a clear cut case of false implication and misuse of dowry
