Heard Sri Shamsher Singh, holding brief of Sri Marjeet Mishra, learned counsel for the applicant, Sri R.P. Patel, learned State Law Officer as well as perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 438 of 2024, under Sections 64(2)K, 333 of BNS Police Station Thana Bhawan, District Shamli, during the pendency of trial. 4. As per prosecution story, the applicant is stated to have inappropriately touched the victim on 05.11.2024 at about 4 p.m. thereby outraging her modesty. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence. The FIR is delayed by about three days and there is no explanation of the said delay caused. It is next stated that there is no medical corroboration of the said incident.
