Heard Sri Deepak Kumar Tripathi, learned counsel for the applicant and Sri R.P. Patel, learned State Law Officer and also perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 559 of 2024, under Sections 64(1), 351(3) of BNS and Sections 3/4 of POCSO Act, Police Station - Gagaha, District -Gorakhpur, during the pendency of trial. 4. As per prosecution story, the applicant is stated to have enticed away the minor daughter of the informant, aged about 16 years in the night of 09/10.10.2024 and committed rape with her and sent her back after threatening her to life. 5. Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in the present case. He has not
