The present bail application under Section 483 B.N.S.S. has been filed on behalf of applicant, Shawej @ Kuda, with a prayer to release him on bail in Case Crime No. 274 of 2024, under Section 8/21/29 of Narcotic Drugs and Psychotropic Substances Act, 1985,\ and 3/25 of Arms Act, Police Station-Gaglheri, District-Saharanpur. Learned counsel for the applicant has contended that 14 Gram of smack powder is alleged to have been recovered from the possession of the co-accused. Learned counsel for the applicant submits that neither the applicant was arrested on spot nor any thing has been recovered from the applicant.
