The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Abrej with a prayer to release him on bail in Case Crime No. 882 of 2024, under Section 109 B.N.S. and Section 3/5A/5B/8 of U.P. Prevention of Cow Slaughter Act, 1955 and Section 11 of Animal Cruelty Act and Section 3/4/25/27 of Arms Act, Police Station- Kotwali Padrauna, District- Kushinagar. Learned counsel for the applicant submits that the applicant is the driver of the vehicle from which six live cattle were found. He next submits that nothing incriminating has been recovered from possession of the applicant. There is no independent witness of the recovery. Offence is triable by magistrate.
