This bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023, has been moved on behalf of accused- applicant, Gulshan, seeking enlargement on bail in Case Crime No. 530 of 2024 under Sections 351 (2), B.N.S. and 3/4 of POCSO Act, Police Station Harduaganj, District-Aligarh. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number. The applicant is languishing in jail since 02.12.2024. First Information Report has been lodged on 26.10.2024 with the allegation that the applicant and two other named persons have committed unnatural sex with the son of the informant. There is neither any eye witness of the incident nor there is any medical report of the victim.
