Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Hariom Gupta, with a prayer to release him on bail in Case Crime No. 517 of 2024, under Sections 376, 354-B, 354-D, 506 IPC and 67 I.T. Act, Police Station Piparaich, District- Gorakhpur, during pendency of trial. Initially, implication of the applicant under Section 354-B, 506 IPC and 67 I.T. was made. Subsequently, on the basis of the statement of the victim, applicant has been implicated under Sections 376 and 354-D IPC. Learned counsel for the applicant has submitted that initially the victim had affair with the applicant, but thereafter some dispute took place between them. Hence FIR was lodged. Incriminating video has been supplied by the victim herself. It has not been made viral. The applicant has been falsely implicated in
