This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Shishu Yadav Alias Abhishek Yadav , seeking enlargement on bail in Case Crime No. 8 of 2023 , under Sections 3/25 of Arms Act, Police Station Kakwan, District Kanpur Nagar. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 21.1.2023. Learned counsel for the applicant submits that applicant was not named in the FIR. His name has surfaced on record on the basis of confessional statement of co-accused Himanshu and police has shown false recovery of one country made pistol and two live car
