The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Rahees with a prayer to release him on bail in Case Crime No. 842 of 2024, under Section 3/5/8 of U.P. Prevention of Cow Slaughter Act, 1955, Police Station- Bhojipura, District- Bareilly. Learned counsel for the applicant submits that the applicant was not arrested from the spot. Applicant's name disclosed in the confessional statement of co-accused. Nothing incriminating has been recovered from possession of the applicant. There is no independent witness of the recovery as alleged in the FIR. Offence is triable by magistrate.
