Applicant seeks bail in Case Crime No. 183 of 2023, under Sections 376-AB I.P.C. and Section 5M/6 POCSO Act, Police Station- Debai, District - Bulandshahr, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The informant has been examined during trial as PW- 1 and is not an eye witness although she has deposed against the applicant. The victim has been examined as PW2 and PW3 is the eye witness, who is the grand mother of the victim. They have been cross-examined by the public prosecutor after declaring them hostile.
