There are allegations against the applicant of committing offence of rape against minor girl. Learned counsel for the applicant submits that status of the trial has been intimated by the trial court which shows that due to absence of prosecution witnesses and several opportunities provided to the prosecution, defence could not crossexamine the P.W.2, victim. Number of date were fixed . Bailable warrants were issued against the witnesses. Applicant has been falsely implicated in this case.Even victim has not made any allegation of commission of rape against the applicant. Victim has refused her internal medical examination.
