Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Shobhnath @ Shobhai Vishwakarma, with a prayer to release him on bail in Case Crime No. 257/2023, under Sections 363, 507, 376 of IPC and section 5/6 of POCSO Act, Police Station Sikariganj, District- Gorakhpur, during pendency of trial. There is allegation against the applicant of committing the offence of abduction, rape and criminal intimidation against a minor girl. Learned counsel for the applicant has submitted that the victim has claimed her age as 18 years in her statement recorded under section 164 Cr.P.C.
