Heard learned counsel for the applicant, Shri Arimardan Yadav, learned AGA for the State-respondents and perused the record. This bail application under Section 439 Cr.P.C.has been moved on behalf of accused-applicant, Surendra, seeking enlargement on bail in Case Crime No. 79/2024, under Sections 3/5/25 Arms Act, Police Station Phugana , District Muzaffarnagar. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 3.12.2024. Learned counsel for the applicant submits that the first information report dated 3.12.2024 was lodged by the informant, Sub- Inspector- Jagdish Singh, Police Station Phugana, District Muzaffarnagar against the applicant and two other co-accused persons namely Birju and Rajkumar.
