Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Suhan Ali, with a prayer to release him on bail in Case Crime No.249 of 2024, under Sections 452, 323, 354-A, 506 IPC and Section 7/8 POCSO Act, Police Station Akbarpur, District- Kanpur Dehat, during pendency of trial. Learned AGA has informed that notice on opposite party no.2 has been served, but no one has put in appearance on behalf of opposite party no.2 to oppose this bail application. There are allegations against the applicant of commission of offence of criminal intimidation and causing intentional insult to a minor apart from committing the offence of penetrative sexual assault. Learned counsel for the applicant has submitted that as per report of C.M.O., the victim is not minor but major.
