Heard Shri Shamshuddin Khan (S U Khan), learned counsel for the applicant, Sri Anil Kumar Singh, learned AGA for the State- respondents and perused the record. This bail application under Section 439 Cr.P.C. has been moved on behalf of accused-applicant, Vikki Alias Vikram, seeking enlargement on bail in Case Crime No. 87 of 2024, under Sections 354ka, 506 of the Indian Penal Code and Section 9m/10 POCSO, Police Station- Moth, District- Jhansi. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 08.04.2024. Learned counsel for the applicant submits that there is no independent eye witness of the alleged incident and parents of the victim have refused for her medical examination. There is no allegation of assault or harm has been made against the applicant.
