The instant bail application has been filed on behalf of the applicant, Sahbaz @ Sameer, with a prayer to release him on bail in Special Session Trial No.821 of 2024, Case Crime No. 132 of 2024, under Sections 363, 376(AB) IPC and 5(m)/6 POCSO Act, Police Station Nautanwa, District- Maharajganj, during pendency of trial. There are allegations against the applicant of abduction of minor girl. Subsequently, implication of commission of offence of rape is also levelled against him. Learned counsel for the applicant has submitted that the victim willingly eloped with the applicant and went to Pipiganj. As per the ossification test report, the age of the victim is 16 years.
