Heard learned counsel for the applicant and learned A.G.A. for the State. The allegation against the applicant of commission of offence of rape, criminal intimation etc. Learned counsel for the applicant submits that the victim has been examined before the trial court where she has admitted that she entered into marriage with the applicant and thereafter entered into physical relation-ship and they lived as husband and wife. Later she did not accept the marriage as it was not performed as per Hindu Marriage Rights. Only garland was put around her neck and marriage was solemnized. Learned counsel for the applicant further submits that in case marriage is void the allegation of comission of offence of rape etc., is unwarranted since physical relationship with consent has been admitted in the statement before the court. Applicant is in jail since 14.05.20
