The instant bail application has been filed on behalf of the applicant, Saurabh, with a prayer to release him on bail in Case Crime No. 647 of 2023, under Sections- 376-AB IPC and Section 5/6 of POCSO Act, Police Station- Sector-39 Noida, District- Gautam Buddha Nagar. Learned A.G.A informs that notice has been served on informant but no one has turned up to oppose this bail application. There are allegations against the applicant of committing the offence of rape against the minor girl aged about 7 years. Counsel for the applicant submits that it is a case of false implication. Learned A.G.A has pointed out to the medico-legal examination the victim which shows that her labia majora and labia minora was swollen and hymen was torned, bleeding was present.
