N. Kanaujiya, learned AGA-I for the State. The instant bail application has been filed on behalf of the applicant, Smt Sitadevi, with a prayer to release him on bail in Case Crime No.292 of 2023, under Section 302 I.P.C , Police Station Iglas, District Aligarh. There are allegation against the applicant that he called the deceased from his house, thereafter his dead body was recovered. Learned counsel for the applicant submits that initially four persons were implicated but later two of them were exonerated but not the applicant. He further submits after rejection of the application of prosecution under Section 319 Cr.P.C the trial is not proceeding. Only two prosecution witnesses have been examined.
