The instant bail application has been filed on behalf of the applicant, Arif, with a prayer to release him on bail in Case Crime No.09 of 2024, under Sections 376 IPC and 3/4 POCSO Act, Police Station Sector-24 Noida, District- Gautam Budh Nagar, during pendency of trial. There are allegations against the applicant of committing the offence of rape against a minor girl besides offence of penetrative sexual assault. Learned counsel for the applicant has submitted that although the victim is minor, aged about 14 years, but in the medical report of the victim, offence alleged does not appears to have been committed. Before the trial court, the victim is not appearing to give her statement. The applicant has been falsely implicated in this case. He is languishing in jail since
