There are allegations against the applicant of causing murder of inmate admitted in Nasha Mukti Kendra. He is stated to be manager of the aforesaid center.. Learned counsel for the applicant submits that applicant has been assigned the role causing fatal injury to the deceased by 'Danda'. Injury no.2, size 2 C.M.x 1 C.M.x bone deep present on back of skull of above hair line was assigned to the applicant.Implication of the applicant under section 302/34 I.P.C. is unjustified.The case will not travel beyond section 304 part II I.P.C. in view of the manner of incident alleged in the F.I.R. and statements of the witnesses. The applicant is in jail since 11.3.2023 and has no criminal history to his credit. On the other hand learned A.G.A has opposed the prayer for bail. Keeping in view the nature of the offence, evidence, complicity of the accused, submissio
