The present bail application under Section 439 Cr.P.C. has been filed on behalf of applicant, Abhishek Kumar with a prayer to release him on bail in Case Crime No. 677 of 2024, under Section 8/20 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Shahpur , District- Gorakhpur. 3. Learned counsel for the applicant has contended that 5 Kg 196 gm. of Ganja is alleged to have been recovered from the joint possession of the co-accused and applicant, which is below commercial quantity. In fact no such recovery was effected from the applicant.
