Heard learned counsel for applicant, learned A.G.A. for the State and perused the record. This bail application has been preferred by the accused-applicant, Lal Bahadur Gharti, who is involved in Case Crime No. .684 of 2023, under Section 8/20 of N.D.P.S. Act, Police Station- Khutar, District- Shahjahanpur. There are allegations against the applicant that he was found in possession of 9 Kg. 637 Gram Charas. Learned counsel for the applicant has submitted that by way of Notification dated 23 December, 2022, the Union Government has notified the enactment Narcotic Drugs and Psychotropic Substances (Seizure, Storage, Sampling and Disposal) Rules, 2022. Chapter II of the aforesaid rules provide for Sampling of the contraband substance.
