This bail application has been preferred by the accused-applicant, Noor Alam @ Aalam Ansari, who is involved in S.T. No. 1620/2023, Case Crime No. 391/2023, under Section- 8/20 of N.D.P.S. Act and section 41, 411, 413, 414 of IPC, Police Station- Ramkola, District- Kushinagar. Learned counsel for the applicant has submitted that applicant has been falsely implicated in the present case due to ulterior motive, on the basis of false and planted recovery of 1 kg, 120 gram of charas and one motor cycle, but there is no public witness of the alleged recovery. It is further contended that mandatory provision of Section 50 of N.D.P.S Act has not been complied with.
