Counter affidavit filed by counsel for the informant is taken on record. There are allegations against the applicant that he committed the offence of cheating and criminal breach of trust against his close relative who is the informant, by assuring him to make investment and get good returns. It is alleged that he has misappropriated an amount of Rs. 52,26,709/- of the informant. Counsel for the applicant submits that it was part of the business and knowing that there is risk involved, investment was made by the informant. There was no intention to cause the alleged offence since very inception. The applicant is in jail since 29.04.2023 and has criminal history of one case to his credit. On the ot
