Later the allegations have been intensified and implication under Section 376 IPC has been made. The victim and applicant reside in the same locality and on account of neighbourly dispute the applicant has been falsely implicated in this case. The medical report of victim does not clearly proves the allegation made against the applicant. Trial has begun. Before the trial court the victim has been examined therefore, there is no possibility of tampering with the evidence.
