This bail application has been preferred by the accused-applicant, Rafeek, who is involved in Case Crime No. 224 of 2023 under Section 8/20 N.D.P.S. Act, and sections 411,413,420,467,468,471 I.P.C. Police Station- Itwa, District- Siddharth Nagar. There is allegation of recovery of 500 Gram Charas from the possession of the applicant. Learned counsel for the applicant has submitted that applicant has been falsely implicated in the present case due to ulterior motive, on the basis of false and planted recovery of 500 Gram Charas and there is no public witness of the alleged recovery. He further submits that the mandatory provisions contained in sections 41,50,52,53 & 57) of the NDPS Act were not complied with while m
