Learned counsel for the applicant submitted that applicant was not named in the FIR and during investigation when co-accused Anand was arrested and his statement was recorded then he disclosed the name of the applicant and as per prosecution, when applicant was arrested then from his possession two mobile phones of the deceased were recovered but entire recovery is totally false and planted one.
