Applicant seeks bail in Case Crime No. 236 of 2023, under Sections 363, 366, 376 I.P.C. and 5/6 POCSO Act, Police Station Mahewaghat, District Kaushambi, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. It is further stated that the victim is the consenting party, as is evident from her statement recorded u/s 164 Cr.P.C., whereby she has stated that she has married the applicant and is living in his house only. 5. The victim, by her looks, seems to be major, although she is 17 years and 3 months old as per school certificate. There is no criminal history of the applicant.
