Heard Sri Randhir Jain, learned counsel for the applicant, Sri Abhishek Kumar Saroj, learned counsel for the informant, Sri Ashutosh Srivastava, learned A.G.A. for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.164 of 2024, under Sections 87, 137(2), 64(2)(m), 65(1) B.N.S., 2023 and Section 5L/6 POCSO Act, Police Station Kapsethi, District Varanasi, during the pendency of trial. 4. As per prosecution story, the applicant and his father are stated to have enticed away the victim on 15.11.2024 at about 4:00 a.m. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by about one day and there is no explanation of the said delay caused. The victim seems to be a consenting party as her consent
