Heard Sri Brijesh Kumar Srivastava, learned counsel for the applicant and Sri Manoj Kumar Singh, learned Brief Holder for the State-respondent. 3. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 185 of 2024, under Sections 302, 393, 352, 201, 34 IPC, Police Station Rajghat, District Gorakhpur, during pendency of the trial in the court below. 4. FIR of the present case was lodged against unknown person and according to the FIR son of the informant was alongwith his friend Aman Rai and in the night after 12 a.m., four unknown persons due to some dispute, committed his murder. 5. Learned counsel for the applicant submitted that nobody was named in the FIR but during investigation when the statement of alleged witness Aman Rai was recorded then he however stated that
