The present bail application under Section 439 Cr.P.C. has been filed on behalf of applicant with a prayer to release him on bail in Case Crime No. 150 of 2024, under Section 8/20 of Narcotic Drugs and Psychotropic Substances Act, 1985, Sections 69, 52, 42, 41, 33 and 26 of the Forest Act, and Section 28/3 of Transit of Timber & Adarsh Forest Product Rules, Police Station Colonelganj, District Kanpur Nagar. Learned counsel for the applicant has contended that 18 Kg Ganja and 15 Kg Sandalwood are alleged to have been recovered from the possession of the applicant. The recovered Ganja is below the commercial quantity. In fact no such recovery was effected from the applicant.
