Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The applicant is not named in the FIR. His name has come up subsequently, in the statement of the victim recorded u/s 183 B.N.S.S., whereby she has stated that she had gone with the applicant out of her own sweet will, as such, she is the consenting party.
