This bail application has been preferred by the accused-applicant, Shubham Tiwari, who is involved in Case Crime No. Nil of 2024, under Section 8/20 of N.D.P.S. Act, Police Station- C.B.N. Ghazipur, District- Varanasi. There is allegation against the applicant that he was found in possession of 34.600 kg ganja alongwith two other accused persons. Learned counsel for the applicant has submitted that applicant has submitted that recovery of aforesaid contraband was made from the joint possession of two persons on one motorcycle. Trial has not commenced as yet. It is further contended that mandatory provision of Section 50 of N.D.P.S Act has not been complied with.
