This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Akash, seeking enlargement on bail in Case Crime No. 68 of 2025, under Sections 8/18/21 of the N.D.P.S. Act, Police Station- Dataganj, District- Budaun. Learned counsel for the applicant submits that the applicant has been falsely implicated. 220 gm Smack and 80 gm Afim is alleged to have been recovered from the motorcycle ridden by the applicant. He submits that mandatory provisions of Section 50 of N.D.P.S. Act has not been followed in this case. The alleged recovery is below the commercial quantity.
