This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Nasir, seeking enlargement on bail in Case Crime No. 65 of 2025, under Sections 8/21 of N.D.P.S. Act, Police Station- Behat, District- Saharanpur. Learned counsel for the applicant submits that the applicant has been falsely implicated. 11.5 grams of smack is alleged to have been recovered from the white polythene bag held by the applicant in his hand. He submits that mandatory provisions of Section 50 of N.D.P.S. Act has not been followed in this case. The alleged recovery is below the commercial quantity. There is no compliance of Section 55 and 52-A of NDPS Act. The applicant is in jail since 18.02.2025 and he has explained the criminal history
