Heard Sri Subedar Shukla, learned counsel for the applicant, Sri S.D. Maurya, learned AGA for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 521 of 2024, under Sections 376 I.P.C, Police Station Bansgaon, District Gorakhpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The victim is a 24 years old and is a consenting party as is but evident from her statement recorded u/s 164 Cr.P.C.. The FIR is itself delayed by about two years and there is no explanation of the said delay caused. 5. It has been further stated that the applicant is languishing in jail since 16.02.2025 and he is ready to cooperate with trial. In case, the applicant is released on bail, he will not misuse the liberty of bail
