The instant application has been filed seeking release of the applicant on bail in Case Crime No. 514 of 2024, under Sections 103(1), 238, 140(1) BNS, Police Station- Dhampur, District- Bijnor, during pendency of the trial in the court below. 3. Learned counsel for the applicant submitted that nobody was named in the FIR but during investigation, applicant has been made accused in the present matter on the basis of evidence of last seen and it appears, evidence of last seen is based on the statements of witnesses Smt. Kamla Devi, Mukesh and Vijendra and their statements were recorded by the Investigating Officer after three months, therefore, even evidence of last seen appears to be unconvincing.
